Elizabeth joined TurksLegal in 2013 as a graduate in the Insurance and Financial Services Group and, has pursued an expertise in life insurance since.
With over 5 years’ experience specialising in disputed total and permanent disability (TPD) and income protection claims, Elizabeth has built a litigation practice acting for life insurers and superannuation trustees in the NSW District and Supreme Courts, the Federal Court of Australia and interstate jurisdictions such as Victoria and Western Australia.
Elizabeth has also acted for life insurers in relation to disputes brought in the Financial Ombudsman Service (FOS) and Superannuation Complaints Tribunal (SCT).
Over the course of her exclusive practice in the life insurance space, Elizabeth has provided advice in relation a number of issues impacting her clients including:
- Liability in the context of disputed and litigated proceedings;
- remedies under s 29 of the Insurance Contracts Act 1984 (Cth);
- the property which vests in a life insurance policy for the purposes of sections 60 and 116 of the Bankruptcy Act 1966 (Cth); and
- conflict of laws arising from Trans-Tasman litigation.
