Upcoming legislative changes

On 18 March 2025, the NSW Government announced its intention to introduce ‘bills designed to curb the rising number of psychological injuries that people are experiencing at work’.

Treasurer Daniel Mookhey has flagged that the legislative changes will look to (amongst other things):

  • amend the WPI threshold for psychological injuries;
  • define the terms “psychological injury” and “reasonable management action”; and
  • establish a bullying and harassment jurisdiction in the NSW Industrial Relations Commission (NSWIRC), which will include a requirement that claims of bullying and harassment be heard in the NSWIRC first before a claim can be made through the workers compensation system.

The proposed legislation is yet to be introduced to Parliament. Turks will keep our clients updated as the Government releases further information.
